§ 28-21. Prohibited acts.

  • (a)

    It shall be unlawful and a violation of this article for any person to dispose of solid waste or litter in or on any public highway, road, street, alley or thoroughfare, including any portion of the right-of-way thereof, or any other public lands, or in or on any freshwater lake, river or stream within the county, except in a lawful manner within a solid waste disposal area provided by and regulated by this article.

    (b)

    It shall be unlawful and a violation of this article for any person to maintain or otherwise dispose of solid waste or litter, in any amount whatsoever, on any private property in such a manner as to cause a sanitary nuisance.

    (c)

    It shall be unlawful and a violation of this article for any person to dispose of any solid waste in the county which was generated other than within the incorporated or unincorporated areas of the county.

    (d)

    It shall be unlawful and a violation of this article for any person to tamper with, burn, deface or otherwise harm or destroy any solid waste disposal area or equipment provided thereon.

    (e)

    It shall be unlawful and a violation of this article for any person to interfere with any agent or employee of the county while in the performance of his duties authorized by county ordinance.

    (f)

    It shall be unlawful and a violation of this article for any person to scavenge, rummage, plunder or otherwise remove any solid waste disposed of at a solid waste convenience center.

    (g)

    It shall be unlawful and a violation of this article for any commercial garbage collector or municipality to use or otherwise dispose of solid waste in a solid waste convenience center.

    (h)

    It shall be unlawful and a violation of this article for any person to deposit in or near any solid waste convenience center any materials other than solid waste.

    (i)

    It shall be unlawful and a violation of this article for any person depositing solid waste in a solid waste convenience center to fail to dispose of the solid waste so that it lies wholly within a county container.

    (j)

    It shall be unlawful and a violation of this article for any person to deposit in or near any solid waste convenience center any tires, appliances, household bedding materials (i.e., bed springs and mattresses) unless within a solid waste disposal container or area provided by or regulated by the county.
