§ 19-204. Refunds.

  • (a)

    Fifty percent of each fire rescue and emergency medical services impact fee collected by the county between June 16, 2005 and the effective date of this ordinance [Ord. No. 2009-02-26-09-01, adopted Feb. 26, 2009] shall be refunded to the record owner of the applicable capital facilities impact construction as of the date of issuance of the refund.

    (b)

    One hundred percent of each roads and law enforcement impact fee collected by the county between June 1, 2008 and the effective date of this ordinance [Ord. No. 2009-02-26-09-01, adopted Feb. 26, 2009] shall be refunded to the record owner of the applicable capital facilities impact Construction as of the date of issuance of the refund.

    (c)

    The county clerk and the county coordinator are hereby authorized to refund $51,756 from the road impact fee trust account, $10,784.40 from the law enforcement impact fee trust account, $24,101.02 from the fire impact fee trust account, and $39,212.08 from the emergency medical services trust account to provide these refunds.

    (d)

    The refunds shall be provided to the current owner of the applicable capital facilities impact construction no later than May 31, 2009.
