§ 4-3. Consumption or possession of alcoholic beverages in open containers.

  • (a)

    It shall be unlawful for anyone to consume or possess open containers of beer, alcoholic beverages or intoxicating liquors off of the premises which is licensed for the sale of alcoholic beverages, except within closed buildings or on premises occupied solely by residential structures. The distance set forth in this section shall be measured from the shortest route of ordinary pedestrian travel along public thoroughfares, from the principal entrance of the establishment dealing in intoxicating beverages, to the location of the violation of this section.

    (b)

    Each establishment dealing in intoxicating beverages shall at all times, when such establishment is open to the public or is dispensing or selling intoxicating beverages or alcoholic liquors, have located in the interior as well as the exterior portions of the building licensed for sale of beverages, at a location at which it can be readily seen and read by customers of the establishment, a sign prominently displayed a minimum size of one foot by two feet, and thereon appearing prominently, in letters of not less than one-half of an inch in height, the following information:

    It is unlawful to consume or possess alcoholic beverages in an open container within 500 feet of this establishment and off these licensed premises. County Code section 4-3.

    (c)

    Signs erected or posted pursuant to Ordinance No. 92-01 as of the adoption date of this Code that reference Ordinance No. 92-01 rather than this section shall be deemed to be in compliance with this section.

    (d)

    It shall be unlawful for the owner of any establishment dealing in intoxicating beverages to fail to comply with this section or for any person to sell, dispense or serve alcoholic or intoxicating beverages in any establishment which is not in compliance with this section.
